There was a motion to accept the minutes of the May 2nd, 2013 meeting.  The motion was seconded and accepted with a vote of 3-0-2; 3 Yes, 0 No, 2 Abstentions.

There was a motion to accept the minutes of the May 16th, 2013 meeting with 5 changes discussed.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

Ms. Michele Grenier’s Agent’s Report has been appended to the minutes.

GENERAL BUSINESS

Minor Buffer Zone Activity:  7 Shawkemo Path
Mr. Paul LaCroix, the homeowner, appeared before the Commission for the construction of a 32’x12’ proposed deck constructed to the rear of his house.  Mr. LaCroix stated that the closest corner of the slab to the wetland line is 34 ft.  It will be screened in and roofed; the sloped roof will be off the back of the house.

A Commission member questioned the applicant when was the house built.  The applicant stated that the house was constructed in 1990.  The Commissioner informed the applicant that this project is not eligible for a Minor Buffer Zone Activity filing as all of the boxes on the first page of the application must be checked and the second is not; therefore, denoting that there is no recorded Certificate of Compliance on record for this property.

A Notice of Intent is required for this project so that the functions and characteristics could be adequately addressed.  The roof drainage and grading could also be addressed in a Notice of Intent.

The applicant stated that he is withdrawing his application without prejudice.  He will confer with the Conservation Agent regarding the filing of a Notice of Intent.

Public Hearing - Notice of Intent – 5 Alexandria Drive – Tanner - CE159-1046
Ms. Kim Tanner, the applicant, appeared before the Commission for the construction of an addition to an existing single-family house.  Ms. Tanner informed the Commission members that it will be an 18’x20’ addition on footings.

A Commissioner informed the applicant of some missing items in the Notice of Intent package that need to be addressed:  

1.  Pg. 4 in the Notice of Intent, - blank page addressing estimated habitat
2.  Pg. 6, Questions 3,4,5 & 6 – all pages are blank  
3.  Critical environmental concern is not addressed
4.  Outstanding resource water is not addressed
5.  Area subject to a wetlands restriction order is not addressed
6.  Storm water management issue is not addressed
7.  The statement regarding the applicant demonstrating that there is no significant individual or   cumulative adverse impact from this work is missing
8.  There are 14 functions and characteristics, only 4 have been addressed
9   there is no project narrative
10. The topo map and delineation reports are missing
11. The construction sequence needs to be either on the plan or in the text

The Commission members will conduct a site walk of the property on Sunday, June 23rd at 8:30 a.m.  

There was a motion to continue the hearing until June 27th.  The motion was seconded and accepted with a vote of 5-0-0.

Continued - Public Hearing - Notice of Intent – 19 Colt Road – Maliff - CE159-1048
Mr. Jon Fournier, Conservation Commission member, recused himself from this public hearing.

Ms. Karon Skinner-Catron, Wetland Consultant, appeared before the Commission for the construction of a pool, shed, walkway and 16’x20’ deck on swimming pool.

Ms. Skinner submitted some pages from the NOI that need to be corrected and a construction sequence plan requested from the Commission at the last meeting.  She also submitted some photos of the site.  

The Commission Chair stated that the functions and characteristics statement was missing from the application.

Ms. Skinner informed the Commission that erosion controls have been installed, silt fence has been put up incorrectly (it is not trenched).  The footings have not been poured but the holes have been excavated.  Ms. Grenier stated that there has been no erosion in the yard at all.

Ms. Skinner stated that the dimensions on the walkway and shed are depicted in the construction sequence.

A Commission member stated that he observed that there is a path in the rear of the site where the homeowner has been dumping yard waste and there is also a large pine tree that was recently cut down.

The Commission Chair stated that all of the functions and characteristics are still missing from this application and requested that this be provided along with an updated narrative.

There will be no heavy equipment on the site and all excavation will be done by hand.

The sizes of the plants for the site were also requested to be shown on the plan.

The Commission requested that the contractor working on the site be contacted and have him
get the sono tubes filled and get the ground stabilized as soon as possible.

A Commission member stated  that the erosion control has not been installed according to the plan submitted.  An engineered plan was requested to be submitted depicting all of the elevations.

A trenched silt fence was requested to be installed, submit an engineered plan and the functions and characteristics statement.  A letter will be issued to the homeowner outlining these requirements.

There was a motion to continue the hearing until June 27th.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

Enforcement:  58 Populatic Street
Mr. & Mrs. Eknaian appeared before the Commission members regarding the enforcement matter imposed on their property for filling and clearing within the buffer zone on their property.

Ms. Michele Grenier informed the Commission of the events leading up to the issuing of this enforcement order and the remediation that the property owners have taken.  Ms. Grenier presented the Commission with photos of the site before and after the work had taken place.

There is an existing enforcement order on the site and the conditions have been restored and they would like to put in more shrubs.  This planting could be added as part of the enforcement order.  

The Commission requested that they put in the shrubs, when this is done  they will notify Conservation Agent who will visit the site and the Enforcement order would then be closed.  

Certificate of Compliance:  Lot 3 Cotton Tail Lane - SE159-906
Ms. Grenier informed the Commission members that the house has been constructed according to the plan and the site has been completed stabilized.

There was a motion to issue a Certificate of Compliance for Lot 3 Cotton Tail Lane. The motion was seconded and accepted with a vote of 5-0-0.

Discussion:  Del Carte Dam 4
Ms. Grenier informed the Commission that someone removed the boards over Memorial Day weekend and drained the whole pond by Dam 4.  It was determined who removed these boards.

It was noted by a Commissioner that he visited the Del Carte site and noted that the kiosk is located 20 ft. from the bait pond; it was supposed to be located at the parking lot up the street.  Ms. Grenier stated that the Eagle Scout performing the work submitted a plan depicting the location of the kiosk.  It was requested that Conservation Staff post the Policy and the Rules & Regulations for Conservation Land in the kiosk.
